By accessing or using OBDNC OS (the "Service"), operated by OBDNC LLC ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

The Service and its original content, features, and functionality are and will remain the exclusive property of OBDNC LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of OBDNC LLC.

Your Content

You retain all rights to any content you submit, post, or display on or through the Service. By uploading content (including construction plans, documents, and project data), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process such content solely for the purpose of providing the Service to you.

Some parts of the Service are billed on a subscription or per-project basis. You will be billed in advance on a recurring and periodic basis or per transaction, depending on the service tier selected.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. You are responsible for payment of all such taxes, levies, or duties.

Refunds are handled on a case-by-case basis. Please contact us at support@obdnc.io for refund requests.

Important Notice:

IN NO EVENT SHALL OBDNC LLC, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• •Your access to or use of or inability to access or use the Service
• •Any conduct or content of any third party on the Service
• •Any content obtained from the Service
• •Unauthorized access, use, or alteration of your transmissions or content

The Service is provided for estimation and planning purposes only. While we strive for accuracy, you acknowledge that AI-generated estimates should be reviewed by qualified professionals before use in actual construction projects.

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

OBDNC LLC does not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from the use of the Service will be accurate or reliable.

These Terms shall be governed and construed in accordance with the laws of Puerto Rico and the United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Puerto Rico, and the parties irrevocably consent to the personal jurisdiction and venue therein.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us at support@obdnc.io.
